Effective [DATE OF LAUNCH]
These terms apply when you send music or other work to Oh Boy Five (“OB5”, “we”, “us”), run by Means Artist Management LLC, through our submission form or by email. Sending a submission means you agree to them.
1. It is free. Always. OB5 never charges to submit, to be listened to, or to be signed. If anyone asks you for money in our name, it is not us. Tell us at hello@ohboyfive.com.
2. You keep your rights. Your music stays yours. Submitting does not transfer any rights to us and does not create a deal, a contract, or a promise to release, promote or pay for anything. Any agreement between us happens only in a written contract that both sides sign.
3. What you let us do. You let us listen to, download, store and share your submission inside OB5 and, when needed to evaluate it, with our distribution partner, Downtown Music, only so we can decide whether to work with you. We will not release, publish, broadcast or post your submission anywhere without your written permission.
4. What you confirm. By submitting, you confirm that:
- you made the work, or you have the right to send it on behalf of everyone who did;
- your collaborators know you are sending it;
- it does not copy anyone else’s work, and any samples are cleared or you tell us they are not;
- it contains nothing unlawful, and no malware.
5. We hear a lot of music. We listen to many submissions and we make and release our own music too. Some of what we already have, or make later, may be similar to what you send, in sound, theme, title or idea. Similarity on its own does not mean we used your work, and receiving your submission does not stop us from working on our own ideas or with other artists. We will never release your actual recordings or songs without a signed agreement with you.
6. Listening and replies. A person listens to every submission. We cannot reply to all of them. If your work fits what we are doing, we will get in touch using the details you gave us. Not hearing back is not a judgement on you or your music.
7. Age. You must be 18 or older to submit, or have a parent or guardian’s consent, and they agree to these terms with you.
8. Your information. How we handle your details is in our Privacy Policy (ohboyfive.com/privacy/). You can ask us to delete your submission at any time.
9. Nothing is confidential by default. Please do not send anything you need kept secret beyond what the Privacy Policy promises. We keep submissions to the people who listen to them, but sending us music does not create a confidentiality agreement.
10. The legal bits. These terms are governed by the laws of Pennsylvania, USA. If any part cannot be enforced, the rest still applies. We may update these terms; the version on this page on the day you submitted is the one that applies to your submission.
